At present, in order to further promote the pilot work of international talent reform, improve the service guarantee level of foreign talents, endow foreign talents in the Industrial Park with autonomy, mobilize the enthusiasm of the park to introduce all kinds of foreign talents in line with the construction needs of Hainan free trade zone and free trade port. Hainan Science and Technology Department carried out the pilot work in Yazhou Bay Science and Technology City and other main park for expanding the scope of foreign talents and setting up service windows for work permits to China. Following the acceleration of the construction of Hainan free trade zone and free trade port, deepening of international cooperation, many foreign high-quality enterprises have actively arranged in the park, the number of foreigners coming to work in the park in Sanya will increase several times over in the further.
Pilot Work has Two Main Contents:
1. Allow to expand the scope of foreign talents (Class A) in Hainan.
Combined with the construction needs of Hainan free trade zone and free trade port, according to the needs of foreign talents for the key industrial parks in the next 1-2 years, on the basis of national classification standards for foreign talents, expand the scope of foreign talents (Class A) independently, establish the talent classification standard in line with the market evaluation orientation. It will be implemented after reporting to the Science and Technology Department of Hainan Province.
2. Delegate the pre-examination and approval authority of foreigners’ work permits in China.
Based on the government service center of key parks, the park management party will hire relevant staff. The staff will go on duty to undertake the function of examining and approving the work permit of foreigners from the park to China after training by Hainan Provincial Department of Science and Technology. The Yazhou Bay Science and Technology City’s staff will go on duty to undertake the function of examining and approving the work permit of foreigners from the park to China after training by Sanya municipal bureau of foreign experts affairs.
Moreover, in order to further standardize the service and management of foreigners working in Hainan, earnestly safeguard the legitimate rights and interests of foreigners and their employing units, and continue to optimize the local environment, improve the service quality, show Hainan’s determination to gather talents from all directions and introduce foreign talents. For all these purpose, Provincial Science and technology department puts forward the approval management mode of “veto review”.
“Veto review” stipulates that the veto should be used carefully in all aspects of foreigner work permit approval proces. In the situation that the employer refused to submit an application for permission, or the submitted application has to be returned or not allowed, et, the case has to be report step by ste. The case will have to be examine and approval by superior approval director.
For the application and handling of foreigner’s work permit in China, the objects of examination and approval are the units employing foreigners and foreigners. This action can optimize the examination and approval system of work permit for foreigners to come to Hainan, strengthen the sense of responsibility and service of the staff in each examination and approval link. It can also prevent the following situation, such as: the consultation and acceptance of the approval work explain the policy at wlil, persuade the application, reject the application and abuse the veto power.
