Civil Engineering Company Fined £10,000 after Truck Accident

A ground worker was struck from behind by a truck at a development site

John O’Flynn Developments, a Swindon Civil engineering company, has been fined £10,000 after a reversing tipper truck seriously injured one of its workers at a building site. The man suffered severe injuries to his left leg including a large puncture wound, severed artery and damaged thigh muscle.

The Cheltenham Magistrates’ Court in the United Kingdom was told by the Health and Safety Executive (HSE) prosecution how the ground worker was struck from behind by the truck off Tommy Taylor’s Lane, Cheltenham. The accident happened in August 2012 and the man does not wish to be identified. He was airlifted to the hospital from the development site and was unable to work for seven weeks. To ensure there was no risk, the road should have been closed to traffic or the site vehicle movements closely monitored and supervised. The most basic safety measures and precautions were not put into place at the development site.

“There were no measures in place to safely segregate workers from vehicles, and as the worker had his back to the reversing vehicle as he used a noisy floor saw, he did not see or hear it approach,” said HSE inspector James Lucas. The company failed to put adequate safety measures in place. An HSE investigation found not enough was done to segregate trucks and moving vehicles from ground workers. After pleading guilty to violating Section 2(1) of the Health and Safety at Work Act 1974, John O’Flynn Developments was ordered to pay a further £3,892 costs.
