Phoenix Attorney Exposes Common DUI Myths

One of Arizona’s most recognized and award-winning attorneys is highlighting some of the key misconceptions people have about DUI laws in Arizona.

Attorney Brian D. Sloan, founder of The Arizona DUI Team in Phoenix is exposing several common myths associated with being charged with Driving Under the Influence.

Sloan says many people make costly mistakes during their arrest because they believe certain myths they’ve heard about what to do when arrested or charged with DUI. There are also a lot of misconceptions about what reasons an officer needs to pull you over.

“One thing a lot of people tend to believe is that you have to be swerving all over the road to get pulled over,” Sloan says. “This is false. An officer can find any number of reasons to pull you over and question you about possible drug, medication, or alcohol impairment.”

Sloan says when that happens, it is important to know your rights and exercise your right to remain silent. People too often needlessly incriminate themselves by saying too much when they are being stopped and questioned.

Another common myth Sloan points out is that people think they can’t be arrested for DUI in Phoenix because they don’t drink alcohol. The fact is that even taking prescription drugs that are prescribed to you by a doctor can land you in jail with a DUI charge.

“Even someone who smoked Medical Marijuana before they decided to drive can be arrested and convicted of DUI,” Sloan says. “That’s because Marijuana is still illegal at the Federal Level, and due to the way the Medical Marijuana Law was written, as it stands now, having a Medical Marijuana card is not a defense to a DUI,” although Sloan says he is working on a creative way to potentially change that way of thinking.
