Homeowner associations benefit greatly from working with professional management companies. Seasoned HOA managers can offer expertise in legal, financial, and HOA governance matters, while also easing the burden of day-to-day community administration. However, there are limits to what an HOA manager can do—and in a new statement to the press, Kuester Management Group details some of those limits.

“We absolutely encourage HOA Board members to consider the full benefits they can get from enlisting a professional manager,” comments Bryan Kuester, President of Kuester Management Group. “However, we also advise acknowledgement of what the management company cannot or should not do.”

The first thing for HOA members to do is look at the community’s governing documents. “Your governing documents will explains some of the things that the management company cannot do,” Kuester notes. “If these documents expressly state that the HOA Board must do X, then you cannot delegate that responsibility to the management company.”

Kuester notes that, when it comes to developing policies, the Board alone has authority—though the management company can offer guidance and also help with enforcement. Additionally, the Board is responsible for creating and approving budgets, though here again, a professional manager can advise.

Legal issues also necessitate that final decisions be made by the Board—though the manager can and should arrange for proper legal guidance, Kuester says.

“There is much that your management company can do to assist you in running a smooth and effective HOA, but it is important to have reasonable and fair expectations,” Kuester concludes.
