LAS VEGAS, NV – 23 Nov, 2015 – The mother of an 8-year-old boy who died May 25, 2010 at Summerlin Hospital in Las Vegas wants her attorneys to question potential jurors on issues of racial bias in their effort to seek justice for her son whom she believes died as a result of medical negligence.

The autopsy of young Nikhelais Costa shows he died due to an acute lung injury as a consequence of anesthetic drug reaction, according to his attorneys.

The attorneys who represent the deceased child and his mother, Nyiesha Costa, filed a MOTION TO AFFIRM “BLACK LIVES MATTER,” and are requesting the judge allow them to delve into issue of racial bias during jury selection.  Ms.  Costa and her attorneys believe the line of questioning is necessary to ensure she and her deceased son are afforded a fair and impartial jury.

In the motion, attorneys Robert Eglet, Dennis Prince, Tracy Eglet and Danielle Tarmu write that “with heavy hearts” they affirm that in legal history “there has been no better time for these issues to be understood and considered.”

Attorneys hope to uncover multiple issues of bias including whether potential jurors believe a black person’s life is as valuable as a white person’s life, and  whether potential jurors believe black people have a greater tolerance for pain than white people.

The motion will be heard Tuesday, November 24, 2015 at 9am in Clark County District Court, Courtroom 14A, Dept. 30 in Las Vegas, NV.
