On March 15, 2016, attorneys Michael E. Zapin and Herman A. Saitz filed a Class Action lawsuit against Loretta Lynch, as Attorney General of the United States, and Thomas E. Brandon, as Deputy Director and Head of the United States Bureau of Alcohol, Tobacco, Firearms and Explosives, as Defendants in the above captioned class-action lawsuit, on behalf of their client, Barry Michaels and millions of others similarly situated.
Barry Michaels, the primary Plaintiff, is a candidate in Nevada for United States Congress and he’s also a convicted felon. Under federal law, Mr. Michaels can run for Congress or even become the President of the United States where he would have his finger on the nuclear trigger; however, he would face a five-year prison sentence if it were on the trigger of a Colt 45.
Michaels alleges the Federal Gun Control Act 18 U.S.C. Section 922(g)(1), as applied to him and millions of other similarly situated law-abiding felons, violates their constitutional rights.

The lawsuit is as much about civil liberties and second class citizenship, as it is about the desire to possess a firearm. The statute’s purpose is to protect the public from violent offenders. Michaels argues, “Non-violent felons pose no greater risk than other law-abiding citizens and to impose a lifelong ban is cruel and unusual punishment under the Eighth Amendment.”
