The heart-wrenching death of an innocent toddler at a Walt Disney World hotel in Orlando this June has left the country, and especially the state of Florida, reeling in disbelief. After wading into one of the hotel’s beach lagoons to splash in its shallow water, 2-year-old Lane Graves was grabbed by an alligator and pulled to his death. The Graves family has received immense public support and sympathy, but none of that will bring their little boy back to them.
This tragedy has called to light Disney’s liability in the incident, a concept that Catania & Catania attorney Robert A. Samartin understands well. In 2005, a 4-year-old boy from Pennsylvania rode Epcot’s Mission: Space, which simulated a trip to Mars using centrifugal force. During the ride, the boy suddenly tensed up, screamed, and became unresponsive. Paramedics on the scene and doctors at the local hospital were unable to resuscitate him, and he ultimately lost his life.
Attorney Robert A. Samartin represented the boy’s family, the Bamuwaymes, in their wrongful death lawsuit against Disney. According to Samartin, Disney did not adequately warn the public of the ride’s hazards, didn’t do enough to help during the medical emergency, and should never have allowed the child on the ride in the first place. “They are exposing the general public to a ride whose forces they don’t really understand,” Samartin explained at the time.
