Hamilton, ON – Smordin Law, a busy criminal law firm in Ontario, is launching a campaign to highlight the importance of knowing your legal rights and calling a lawyer as soon as possible following arrest. This basic information is some of the most important knowledge any citizen should possess, and yet many people are unaware of their rights.
In Canada, if you are charged with an offence under Federal law (Criminal Code of Canada, for example) or Provincial law (Highway Traffic Act, for example), you have the right to:
- Be told quickly of the offence you are charged with
- Be given access to counsel upon arrest before you speak to the police
- Have a trial within a reasonable amount of time
- Choose not to testify at your own trial
- Only be tried or punished once for an offence
For a complete list of your rights, or more information, refer to the Canadian Charter of Rights and Freedoms.
“The process of being arrested can be one of the most stressful and scary experiences in a person’s life,” says Sandee Smordin senior counsel and founder of Smordin Law. “People can make poor decisions, through worry or fear, and in a lot of cases, they are simply not thinking straight. The legal process provides any person who is arrested with the right to legal advice, and it is our belief that people should take advantage of this right and never waive this right. All too often we see cases where upon arrest people tell the police “I’ll call a lawyer later” or “It’s alright, I don’t need a lawyer”. This is a mistake that can drastically affect the outcome of the case. A lawyer is an expert in the law and will ensure that procedures are correctly followed. A lawyer is not emotionally involved so they can provide the best legal advice.”
Smordin Law is a firm of lawyers and paralegals that specializes in criminal law. The firm has been in business for over ten years, and the lawyers have defended hundreds of people in various cities throughout Southern Ontario.
