Medical malpractice is not something most people like to hear about or want to happen to themselves or their loved ones, but unfortunately it does happen from time to time in our medical facilities. This week, the family of a woman was awarded $21.9 million in damages for injuries received in what should have been a routine procedure at the South Eastern Ambulatory Surgery Center.
Gwen Brown had been sedated and was receiving treatment for backache in the form of steroid injections from Dr Doherty. Her breathing became erratic, her blood pressure rose and because she didn’t receive enough oxygen for up to 10 minutes her brain became so damaged that she was left without the ability to move, except her eyes. She lived with this condition from 2008 to 2014, when she finally succumbed.
Most families don’t complain when unfortunate things happen in medical facilities, typically putting it down to bad luck if one of their loved ones is either injured or loses his or her life due to the action of a medical professional. This time, the family of Mrs. Brown recognized that Dr. Doherty took no action when she was obviously affected by the steroid injections and it was this that destroyed her life.
The plaintiff in this lawsuit was Mrs. Brown’s husband, Sterling Brown. Jay Sadd, of Slappey & Sadd, LLC, who represented him, said he was disappointed that punitive damages were not awarded. The Fulton County jury hearing the case had stated that Dr. Doherty had displayed wanton and willful misconduct that justified such damages as he had not attended to his patient’s needs in the way one would expect of a medical professional.
Dr. Doherty’s liability in the compensation award came to 50% of the total, while the Surgery Center was found liable for 30% and South Eastern Pain Specialists, Dr. Doherty’s immediate employer was found liable for the remaining 20%.
