Canada Making Improvements to Processing Times for Immigration, Including Spousal and Common Law Sponsorship

Government offices and officials have struggled to keep up over the last two years of the covid-19 outbreak. From team member shortages to increased applications, these offices are taking longer than average to move the paperwork along and make decisions. That may be coming to an end soon. Meaning that spousal sponsorship and common law sponsorships could be approved more quickly.

The Immigration, Refugees, and Citizenship Canada (IRCC) office is set to get funding to speed up the process. They’ve also planned updates to the processing times and tools used on the website. Including a tracker for the spousal and common-law application process and an online application portal.

There are a variety of ways to immigrate to Canada. Express entry is one of the options for workers who have specific skills. There are three subcategories of skilled worker programs in the express entry category. Canadian Experience Class, Federal Skilled Worker Program, and the Federal Skilled Trades program. Each of these has its own requirements. However, for those who qualify, this is one of the fastest choices for immigration. Even this, however, has been slowed drastically by the pandemic taking on average 8 months for a decision. This is one of the programs that the increase in funding should help improve.

Spousal sponsorship and common-law sponsorship are designed for long-term relationships with a Canadian Citizen, Registered Indian, or Permanent Resident. The sponsoring partner must be 18 years of age. The sponsor must also commit to signing what is called an undertaking agreeing to be responsible for the financial support of the incoming spouse or partner and any dependent children. The spouse or common-law partner class is designed for those couples who cohabitate.

Some factors may disqualify someone for this type of sponsorship. For example, one disqualifying factor is the spouse or common-law partner doing the sponsoring can not be receiving any social assistance aside from disability.

Spousal and common-law immigration applications are immensely complicated. There are a variety of requirements that must be met and qualifications that both parties must pass before being approved. Suppose the couple qualifies for this form of imigration. In that case, they must fill out an application with all the paperwork correct and any required documentation. The IRCC recently launched an online application portal that is not yet fully implemented. It has, however, already allowed the wait time for application decisions to return to pre-pandemic speeds of 12 months. The goal is to lower that time even further.
